General Terms of Service (GTS)

Article 1 - General Scope and Purpose of the GTS

The present General Terms of Service (GTS) determine and regulate the relationship between you as a customer and our company during your interactions with our website https://www.wowsamui.travel and/or our wowsamui.travel application.

The brand wowsamui.travel is an official commercial trademark of the company Koh Samui Voyage Co Ltd.

Placing an order and/or purchasing on our website and/or our application signifies your express and unconditional acceptance of these GTS without any reservation or protest. Our company reserves the right to modify or adapt these GTS at any time and without prior notice. These GTS are directly applicable as soon as they are published on our website and/or our application and/or are sent to you by any means. Please read these GTS carefully before using, interacting with, or accessing our website and/or our application. By accepting these GTS, you guarantee that you have reached the age of legal majority in your country, state, or province of residence. If you are a minor, you guarantee that you possess all necessary authorizations and consent from your legal representatives for the use of our services. You are not authorized to use our services, website, and/or application for illegal or unauthorized purposes. You must not attempt to carry out cyber-attacks, alter the use or functions of our services, send computer viruses, or conduct or attempt to conduct any type of attack against our services. You must not undermine the integrity of our services.

Article 2 - Ordering Process

Our company may or may not require its customers to register beforehand to place an order.

2.1 Registration Registration is not mandatory to place an order on our website or our Android and IOS application. If the customer wishes to register to place an order on our website and/or our application, the customer must first create an account. To do this, the customer must fill out the form available on our website and/or application. The customer will choose a username and a password linked to a functional email address. By doing this, the customer agrees to keep their identifiers confidential, to store them securely at all times, and undertakes not to communicate them to third parties. The customer must keep their confidential identifiers private at all times and must not share them with anyone. Our company will not be held responsible for unauthorized access to the customer's account or fraudulent use of the account, even if fraudulent orders are placed using the customer's bank details. The delivery address must be as precise as possible (building address and number, floor, access code, etc.).

2.2 Placing an Order The customer must choose their services directly from our website https://www.wowsamui.travel or on our wowsamui.travel application (subject to product availability). The customer will select “Delivery” when placing their order on the website or the application. If the “Delivery” option is chosen, the customer must fill in their postcode and address to verify whether they are located in an area where this delivery method is available or not. If the “In-Store Pickup” (click and collect) option is chosen, the order will be processed and available directly at the store, and the customer will then have to come and collect it in person (the store address and opening hours will be mentioned in the order confirmation email). The “Delivery” option may require the customer to pay additional fees (insurance, shipping costs, express delivery, next-day delivery, same-day delivery, courier delivery, etc.). In the shopping cart, the customer will have the opportunity to review and control their order before proceeding to the final payment for the order.

2.3 Availability and Description of Stays and Activities Stays and activities are subject to variations in their availability, and modifications may occur without notice. If an activity is no longer available in stock, we will do our best to inform our customer. We may also stop the commercialization of a stay or an activity at any time and without notice. The description and details of our stays and activities may not be exact and may be modified at any time and without notice. Our company sells stays and activities that may be available in limited or restricted quantities or for a temporary period. The prices in effect are mentioned before the conclusion of the order. Prices are listed in THB (and an equivalent in €), and these prices include the 7% Thai VAT and all other taxes. Article 4 - Payment

The available payment methods will be mentioned to the customer in the summary of their order. Electronic payment methods will be indicated if available, as well as the possibility of paying in cash (at our agency in Koh Samui) or via bank transfer. All bank data, credit card numbers, and other means of payment are encrypted and are never stored on our website and/or our application. We use third-party payment services.


Article 5 - Invoicing

Our company will issue an invoice, in accordance with the law, or any other financial or accounting document as soon as your order is processed by our services. This invoice or other accounting document will be sent via email which will be dispatched with your order. Our company reserves the right to refuse or cancel an order placed on our website and/or application without any warning or justification. If the order is canceled, we will send a refund to the original payment method used by the customer. To ensure accurate invoicing, the customer must provide us with correct and true information. The customer must ensure that their data is kept up-to-date and accurate.


Article 6 - Guarantees

We will do our utmost to fulfill the order placed by the customer. If a service is missing or unavailable, we will inform the customer as soon as possible.


Article 7 - Liability

Our company shall not be held responsible in the event of network unavailability, viruses, external access, fraudulent use of payment methods, or any other type of technical problem or issue.


Article 8 - Third-Party and External Links

Some of the content available on our website and/or application may contain data from third parties or external sources. Third-party links on our sites and/or applications may redirect you to external websites over which we have no control and which have no connection with our company. We are not responsible for the verification and control of the content or the accuracy of third-party sites or links or external sources. If all or part of an article or the present document or any other document contractually in force between you and our company should be recognized by a competent jurisdiction as illegal, void, or devoid of any effect, then only that part shall be excluded, and the remainder of the provisions or the document shall remain in force between the parties. The part declared ineffective shall be removed, but this shall be without effect on the remainder of the provisions or the document from which the part or provision was removed.


Article 12 - Termination

All rights and obligations between the parties that occurred before the termination date remain in force. These GTS are in effect as long as they have not been terminated by either party. The customer may notify our company that they no longer wish to use our services or may simply cease using or accessing our services, websites, and/or applications. Our company may terminate this agreement at its sole discretion at any time and without notice. The customer shall remain liable for any payments due to our company.


Article 13 - Applicable Law and Competent Jurisdiction

The present GTS are governed by Thai law. Any dispute arising from these GTS concerning, but not limited to, their validity, interpretation, execution, consequences, and others shall be brought before the competent jurisdiction. The competent jurisdiction is the Koh Samui Court.
